I hired a vendor in May 2026 for a service and put down a deposit. I need to sue for non-performance and to get my deposit back. The amount is too small for small claims but not much bigger.

You should be able to get the deposit back without much trouble. After all, you've already agreed to the terms. It's likely that a lawyer could draft a simple document to facilitate the return of your deposit, which might be enough to prompt the other party to cooperate.

My significant other is working with a lawyer named David Wize for a civil matter. He's been providing good service so far and is reasonably priced; the retainer fee is $3,000.

You could consider filing a lawsuit in small claims court. The $5,000 limit is higher than the amount you're seeking, and the filing fee is only $58, plus a small cost for postage to serve the other party. You could also seek compensation for your damages and court costs.
