Hamilton Pioneers Landmark Heat Protection Bylaw for Renters
A few months ago, I was walking through the streets of downtown Hamilton, feeling the oppressive heat inside a high-rise apartment. It made me think about the challenges faced by many expats and digital nomads like me, who call Toronto home. Now, Hamilton is taking a significant step to protect its residents from extreme indoor heat with a new bylaw that could set a precedent for other cities, including Toronto.

The bylaw, which will be piloted in downtown Ward 2, requires landlords to keep at least one room in each rental unit below 26°C. This threshold is recognized by Health Canada and aims to safeguard tenants from the harsh realities of climate change. As someone who works with many newcomers, I understand the importance of this move. It could provide much-needed relief for those who might not have the resources to install air conditioning or who are living in older buildings without proper cooling systems.
The pilot will run through September 2028 and could inform future city-wide policies. For now, landlords in affected areas will need to ensure at least one room stays cool, with some exemptions for structural or physical barriers. Tenants can also opt out if they prefer not to comply. The implementation of this bylaw could also impact rent increases, with landlords potentially seeking higher rates to cover AC costs. However, the lack of consistent funding for property owners to complete retrofits remains a concern.
