What happens if I don't pay a debt to the bank due to identity theft?

What happens if I don't pay a debt to the bank due to identity theft?

I had my phone number stolen and someone accessed my bank accounts. They made purchases and deposits in Santander and Falabella, and now they're charging me for a personal loan I never asked for. I've been trying to resolve this for 4 months, but they're still sending me emails saying they're working on my case. If I don't pay the loan, what will happen?

You should take your complaint to Condusef. That's the only way they'll take action.

It's also worth noting that the longer you wait, the more in the bank's favor it will be. They'll just keep trying to get you to pay the debt rather than accepting their own security failures.

Before you do anything, gather all the information you have, including dates, emails, and phone calls. Then, go to Condusef and the MP to file a complaint in writing. This will help document that you're a victim of a crime and that you're trying to resolve the issue. If you have proof, share it with the bank and they'll probably take a closer look at your case.

As soon as you realized someone was using your name, you should have filed a police report and closed your bank accounts. Now, you should try to pay the interest on the loan to avoid paying even more interest while you wait for the judge's decision. If you're lucky, the judge will rule in your favor and you'll get everything back.
