Who to report to when a builder digs through our lot line?

We just moved into our new home in Calgary and the builder is digging through our lot line. The backhoe kept hitting our home and was shaking. Plus, they used our backyard as storage for their equipment. We want to know who to report this to.

Repairing landscaping and other damage is usually the homeowner's responsibility, but the excavator should not be hitting your home. If they did, document everything and talk to both the excavator and general contractor. Additionally, the contractor needs your permission to store materials on your property.

It's unlikely that the excavator hit your house multiple times, as they would likely post pictures of the damage if it occurred. However, it's possible that the vibrations from the equipment caused some discomfort due to the close proximity of the construction site.

Before taking any action, it's essential to review the property's title and look for any ZLL easements or agreements. Many homebuyers are unaware of these agreements, which can affect their property rights. If the contractor has damaged your house, contact your insurance company immediately and provide evidence. Then, work with the contractor to resolve the issue.

It's likely that the property has a ZLL easement, which allows the contractor to excavate. Given the location, it's also possible that the equipment never actually hit your home, as there would likely be significant damage if it did. Document any damage and consider contacting the builder about storage in your backyard if it's causing issues.

As you purchased a house with a zero lot line, it's not surprising that your neighbor's house is close and requires excavation for the footings and foundation. Your lot line is the edge of your home plus the soffit, and you have no access to that side once the houses are built. You should have been aware of this when you signed your building agreement, so it's not unexpected that the construction of a house next door is underway.
